TERMS AND CONDITIONS

1. The Promotion 

1.1 By entering, or otherwise participating in, the Grange Werribee Builder Referral Promotion (“Promotion”) you are deemed to have read and accepted these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not enter or participate in the Promotion. 

1.2 The promoter is YourLand Realty Pty Ltd ACN 635 068 932 of Level 2, 25 Ross Street, South Melbourne VIC 3025 (“Promoter”). 

1.3 The Promotion commences at 9:00am AEST on 26 November 2021 and closes on 11.59pm AEST on 31 January 2022 (“Promotion Period”).

1.4 The Promoter reserves the right to vary the terms of, or cancel, the Promotion at any time without liability to any participant or other person, subject to applicable laws.

2. Conditions of Entry 

2.1 Employees, directors and other representatives of the Promoter are ineligible.  

2.2 Incomplete entries may be deemed to be invalid at the discretion of the Promoter.

2.3 There is a limit of one (1) entry per person, per purchase.

2.4 The Promoter is not responsible or liable for any attempted entries that are not received for any reason, illegible entries, incorrect transcription of entry information, technical failures of any kind in relation to entry to the Promotion, the unavailability of any service in relation to entry to the Promotion, third party interference and technical or human error in relation to the administration of the Promotion. Late entries will not be accepted. 

3. Eligibility

3.1 The promotion is applicable for Titled Lots 7-12 in the Gravid & Phipps releases of Stage 1 as they appear on the corresponding Plan of Subdivision.

3.2 To enter the Promotion: 

(a) you must complete in full (including your details and the individual’s details that you are referring (“Referee”)) and deliver the attached referral application form (“Application Form”) to the Grange Werribee Sales Team by way of email to hello@grangewerribee.com.au within 3 business days of the initial referral; and

(b) the Referee must:

(i) have signed a contract of sale (in the form to be provided by the Promoter) which is unconditional prior to the end of the Promotion Period for an eligible block of land within Grange Estate (“Referee Contract of Sale”); 

(ii) have completed the cooling off period under the Referee Contract of Sale prior to the end of the Promotion; 

(iii) comply with all terms and conditions set out in the Referee Contract of Sale at all times prior to settlement;

(iv) complete settlement in accordance with the terms and conditions set out in the Referee Contract of Sale; and

(v) not already exist on the Grange Werribee database at the time of the referral.

(c) you must be a registered builder within the State of Victoria.

3.3 By signing and delivering the Application Form in accordance with clause 3.1(a) of these Terms and Conditions, you and the Referee agree to these Terms and Conditions.

3.4 For the avoidance of doubt, if there is more than one individual listed as the purchaser in the Contract of Sale, this is deemed to be one entry for the purpose of the Promotion. 

4. Rebate 

4.1 The Rebate consists of a one off payment in the form of a Visa Gift Card for the value of five thousand dollars (AUD $5,000.00) inclusive of GST (“Rebate”). 

4.2 The Promoter will arrange for the Rebate to be delivered to you within 60 days of settlement of the Referee Contract of Sale.

4.3 The Rebate is not exchangeable for any other goods or services. 

4.4 The Rebate is subject to availability. The Promoter reserves the right to amend, withdraw or substitute the Rebate or any component of the Rebate in the event of any unforeseen circumstances outside its reasonable control. 

5. General 

5.1 To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of entry or participation in the Promotion or receiving the Rebate or any aspect of the Promotion or the Rebate. 

5.2 The Promoter expressly denies and excludes all representations about the Promotion or the Rebate except as set out in these Terms and Conditions. 

5.3 The Promoter’s decision is final and no correspondence will be entered into. 

5.4 The Promoter is not responsible for any tax implications that may arise from receiving the Rebate. Independent financial advice should be sought in relation to receipt of the Rebate.

5.5 The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any person who is in breach of these Terms and Conditions or has engaged in any improper conduct in connection with the Promotion in its absolute discretion. 

5.6 The Promoter will collect personal information of both you and the Referee to conduct the Promotion. The Promoter will conduct the promotion in accordance with the Promoter’s Privacy Policy which is available here 

5.7 Entrants consent to the Promoter using their name, image and/or voice, including a photograph or recording, in any media for an unlimited period without remuneration for the purpose of promoting the Promotion, future promotions and/or the Promoter. 

5.8 The Promotion shall be governed by the laws of Victoria, Australia.
